New rules for ITE capillaries and approaches

Decree 2017-439 "local railway lines supporting the transport of goods" and the decrees dated March 30, 2017 and February 6, 2018 govern the safety of rail freight lines without passengers outside the RFN, comparable networks or port tracks.

This decree creates a new rail traffic safety regime applicable to infrastructures on which goods only circulate. This regime determines the operating and maintenance rules necessary to guarantee the safety of rail traffic and makes the development of a safety management system (SGS) compulsory.

At the same time, the implementing decree of 03/30/2017 specifies in particular the content of the SMS, the internal control and external audit procedures, the obligations of the inspection bodies, the management of safety events and emergency situations. emergency, as well as the procedure for authorizing the commissioning of these railways

Similarly, the decree of 06/02/2018 publishes the Guides necessary for the concrete application of the new regulatory provisions (see tab below).

The following in particular are concerned by these texts: the infrastructure managers, the railway undertakings or the undertakings traveling on the infrastructures, subject of this decree.

As a reminder, all of the players in the sector were associated with the drafting of these texts by the Directorate General for Infrastructure, Transport and the Sea (DGITM), from November 2015.

Entry into force in several stages

These texts entered into force on 1er April 2017 with the following conditions of application (article 29 of the decree):

· For railway operators in charge of traffic on the approach tracks of branched establishments, the obligation to develop an SMS adapted to the nature of the safety issues of the infrastructure and its operation comes into force on 1er April 2019; the first external audit relating to the infrastructure operated on the date of entry into force of this decree is carried out within 3 years following the date of April 1, 2019.

· For other operators, the obligation to develop an SMS comes into force on 1er July 2017; the first external audit relating to the infrastructure operated on the date of entry into force of this decree is carried out within 3 years following the date of 1er July 2017.
